By accessing or using our website, CRM system, marketing materials, services, or franchise network, you (“User”, “Customer”, “Franchisee”, or “Partner”) agree to comply with and be bound by the following Terms and Conditions.
If you do not agree, please do not use our services.

1. Introduction

Proffiz Realty is a real estate marketing and facilitation platform offering property brokerage, builder partnerships, loan assistance, CRM tools, and franchise opportunities across India.
These Terms govern your use of our platforms, services, and all business interactions with Proffiz Realty and its franchise offices.

2. Eligibility

To use our services, you must:

• Be at least 18 years old and legally competent to enter into a binding contract.

• Provide accurate and verifiable information during registration or inquiry.

• Use the services for lawful purposes only.

3. Scope of Services

Proffiz Realty provides:

• Marketing, listing, and promotional services for residential and commercial properties.

• CRM and lead management tools for franchisees and channel partners.

• Loan assistance facilitation through authorized financial institutions.

• Franchise business opportunities under the Proffiz brand.

All services are provided on a facilitation basis only.
Proffiz Realty does not own, construct, or develop any of the properties listed.

4. Relationship with Builders, Banks, and Vendors

Proffiz Realty acts as an intermediary connecting buyers, builders, and financial institutions.
We are not responsible for project delays, cancellations, quality issues, or disputes between customers and third-party developers or banks.
All terms, prices, and offers displayed are subject to change based on builder and vendor agreements.

5. Franchise and Channel Partner Conduct

• Franchisees and Channel Partners are independent business entities, not employees or agents of Proffiz Realty.

• They must follow the Franchise Agreement, CRM guidelines, and brand policies issued by the Franchisor.

• Any misuse of the Proffiz brand, logo, or confidential data may lead to suspension or termination of access.

• Customers are advised to verify the credentials of the local franchise before making any financial commitment.

6. Intellectual Property Rights

All content, trademarks, designs, software (CRM), graphics, and materials on Proffiz platforms are exclusive property of Proffiz Realty.
You may not copy, modify, distribute, or reproduce any part of our content without written authorization.
Unauthorized use may lead to legal action under applicable intellectual property laws.

7. Payments and Commissions

• All payments must be made through official channels designated by Proffiz Realty.

• Franchise and marketing service fees are non-refundable, except in cases explicitly approved under the Return & Refund Policy.

• All commissions and payments are subject to TDS and statutory deductions, and may vary from time to time based on builder and vendor agreements.

8. Confidentiality

All users, partners, and franchisees must maintain confidentiality of customer data, CRM information, and business strategies shared by Proffiz Realty.
Any unauthorized disclosure, copying, or misuse of company data will be treated as a breach of contract and may result in termination or legal action.

9. Data Privacy

Your use of our website, CRM, and services is governed by our Privacy Policy, which explains how we collect and protect your personal data.
By using our services, you consent to the data practices described in that policy.

10. Limitation of Liability

Proffiz Realty shall not be liable for any:

• Loss, damage, or expense caused by third-party builders, banks, or partners;

• Inaccuracies or typographical errors in listings or materials;

• Business losses, lost profits, or indirect damages.

Our liability, in any case, shall not exceed the service fee paid to us for the specific transaction in question.

11. User Obligations

Users agree to:

• Provide accurate information at all times.

• Avoid uploading illegal, defamatory, or misleading content.

• Use the CRM and services only for legitimate property or business purposes.

• Refrain from impersonating any other person or entity.

Any misuse or fraudulent activity will lead to suspension of access without refund.

12. Termination

Proffiz Realty reserves the right to:

• Suspend or terminate any account or franchise for non-compliance, misuse, or illegal activity.

• Remove any content that violates these Terms or applicable laws.

• Forfeit pending commissions or benefits in cases of proven misconduct or breach.

Users may also terminate their use of the services by providing written notice.

13. Indemnity

You agree to indemnify and hold harmless Proffiz Realty, its directors, employees, and affiliates from any loss, claim, or damage arising out of your:

• Violation of these Terms;

• Misuse of our platform or brand;

• Breach of confidentiality or data misuse.

14. Modifications

Proffiz Realty reserves the right to amend or update these Terms & Conditions at any time.
The latest version will be available on our website, and continued use of our services implies acceptance of the updated Terms.

15. Governing Law and Jurisdiction

These Terms shall be governed by the laws of India.
Any disputes shall be subject to arbitration under the Arbitration and Conciliation Act, 1996, and the exclusive jurisdiction of the courts at Chennai, Tamilnadu.
